A divorce can be time-consuming, expensive and often difficult.  A do it yourself divorce can save you time and money but only if you complete all of the necessary forms correctly. Using these online divorce forms, you can quickly and easily achieve your goal.  Our unique online program will walk you through filling out the appropriate information and then generate the forms you need to proceed.

GETTING STARTED

Before using our do it yourself divorce system with the online divorce forms, make sure that you meet the following requirements:

• You do not have any children or have resolved all issues with respect to custody and support of the children.

• You have resolved any issues with respect to division of family assets and spousal support (if you are not sure then you need to obtain legal advice). Your issues may have been resolved by way of orders made in another proceeding, such as a Provincial Court proceeding or resolved by way of a written separation agreement or oral agreement. If you have an oral agreement settling any of the above issues it is strongly recommended that you obtain legal advice before proceeding.

• You or your spouse have resided in British Columbia for at least one year prior to commencing your divorce proceeding.

• You expect that this divorce proceeding will proceed on an uncontested basis or is proceeding by agreement. 

• You have the grounds to proceed. It is expected that you will be proceeding on the ground that you have been separated from your spouse for at least one year by the time that you make application for the divorce order itself.

Independent Legal Advice

Online divorce forms provide an easy way to start or complete your do it yourself divorce proceedings, but do not take the place of legal advice. Obtain legal advice from a lawyer in your area, so that you will understand your rights and obligations. If you have any outstanding issues between you or your spouse or are not sure if issues exist, seek advice from a lawyer.

If you do not know a lawyer, call the Lawyer Referral Service to locate a lawyer in your area that can provide you with initial advice for a nominal fee of $25.00 for the first half hour.

The Family Justice Counsellors provide a free service if you need assistance mediating with your spouse.

Additional Requirements

You will need a copy of your marriage certificate or certified copy of marriage particulars, available from Vital Statistics. If you were married in British Columbia you need to apply to Vital Statistics or if not within BC, then at another other jurisdiction.
